Terms and privacy in plain language.

Two documents, one page. What we collect and why, and how a project runs from proposal to handover, set out point by point.

01Privacy policy

We keep what you send us, plus a few technical details against abuse, and sell none of it.

GDPR, in the order a client actually asks about it. Controller: Aktify Studio, Antwerp, Belgium.

  1. 01Who we areAktify Studio (Hakan Aktepe, sole trader), August Wynlaan 15, 2845 Niel, Belgium (VAT BE 1025.803.803), operates aktifystudio.com and is the controller of the data described here. Questions: contact@aktifystudio.com or WhatsApp +32 471 54 16 92.
  2. 02What we collectWhat you type into a form (your name, email address, phone number, current website and your message) and anonymous, aggregated traffic statistics: which pages were viewed, from which country, referring site or campaign link, on which type of device and browser, how far down a page people scroll and how long they read it, where on a page they click, which of our links they use (phone, email, WhatsApp) and how fast pages load. They are counts per day: none of them is tied to you or kept per visit. With a form submission we also store your browser type (the user agent your browser sends with every request) and a one-way hash of your IP address, to detect abuse. The address itself is never written down and the hash cannot be turned back into it.
  3. 03Cookies, and why there is no bannerWe set no tracking cookies, run no advertising or marketing scripts, and show no cookie banner, because there is nothing to ask your consent for. Our analytics are cookieless and store nothing on your device: they count a visit without identifying the visitor, build no profile, and cannot follow you to any other site. They do look for one setting in your browser: a switch we put on our own devices so our own visits are not counted, which is never written on yours. The one cookie we do set is written only when you use the EN/NL switch: it holds those two letters for a year so the site stays in the language you picked. It identifies nobody, is read only by this site, and needs no consent, which is why there is still no banner.
  4. 04Spam protectionOur forms check that a person is sending them: an invisible field that only a bot fills in, how quickly the form was completed, how often it arrives from one connection, Cloudflare’s invisible bot check (Turnstile), and whether the domain of your email address can receive mail. That check looks at your browser, never at what you type, and shows you no puzzle; Cloudflare’s Turnstile privacy policy applies to it (cloudflare.com/turnstile-privacy-policy). A submission these checks turn away never reaches our client records: it is kept apart for 90 days, only to see what the checks catch and whether a real person was turned away by mistake, and then deleted automatically. The basis is our legitimate interest in keeping the forms free of abuse (GDPR art. 6(1)(f)).
  5. 05Why we use it, and on what legal basisYour enquiry is used to answer you (starting with an automatic email confirming it arrived), prepare a proposal and follow up on it by email, phone or WhatsApp while it is open. The basis is taking steps at your request before entering into a contract (GDPR art. 6(1)(b)). Ask us to stop following up and we will. A newsletter signup rests on your consent (art. 6(1)(a)), which you can withdraw at any time. Aggregated traffic statistics rest on our legitimate interest in knowing whether the site works and where it can be clearer (art. 6(1)(f)). We do not sell your data, and we make no automated decisions and build no profiles about you.
  6. 06Who we share it withFour processors handle what you send through this site, each bound by their own data processing terms: Cloudflare (hosting, cookieless analytics and the bot check on our forms), Supabase (form storage, hosted in the EU, Ireland), Notion (our CRM, where an enquiry becomes a client record) and Resend (sends our automatic emails, the confirmation of an enquiry or a newsletter signup, from the EU, Ireland). Cloudflare, Notion and Resend are US companies and process personal data under the European Commission’s standard contractual clauses. If you choose to talk to us on WhatsApp, by email or on Google Meet, that conversation also passes through that service, under its own terms. Nobody else receives your data, and it is never sold or shared for advertising.
  7. 07How long we keep itAn enquiry that becomes a project is kept for as long as we work together, and afterwards for the seven years Belgian bookkeeping law requires of records attached to an invoice. An enquiry that goes nowhere is deleted within two years. A newsletter address is kept until you unsubscribe; one that is never confirmed is deleted after 30 days. So that no address gets more than one automatic email a day, we keep a scrambled (hashed) form of it for two days. A submission our spam protection turned away is deleted after 90 days. Ask us to delete something sooner and we will, unless the law requires us to keep it.
  8. 08The newsletterSubscribing stores your email address and the language you signed up in, nothing else, and it is the only way onto the list: sending an enquiry never subscribes you. The one email before you confirm is the confirmation link itself; nothing else is sent until you click it, every newsletter carries a one-click unsubscribe that deletes the address and the record of what we sent it, and the list is never shared, sold or used to build an advertising audience.
  9. 09Your rightsUnder GDPR you can ask for access to your data, its correction, its erasure, a restriction on how we process it, a copy in portable form, and you can object to processing. Where processing rests on consent you can withdraw it at any time, without affecting what was lawful before. One message to contact@aktifystudio.com is enough. We reply within 24 hours and complete the request within a month, the limit the GDPR sets. If you are not satisfied you can lodge a complaint with the Belgian Data Protection Authority (Gegevensbeschermingsautoriteit / Autorité de protection des données), Drukpersstraat 35, 1000 Brussels, contact@apd-gba.be.
  10. 10Disclosure and securityWe may disclose personal data in a merger, acquisition or asset sale (with notice), when required by law or public authorities, or in good faith to protect rights, safety or against liability. Data is held on encrypted connections and access is limited to what delivering your project needs; no transmission or storage is ever 100% secure, so we use commercially acceptable means but cannot guarantee absolute security.
  11. 11Children and linksThe service is not addressed to anyone under 13 and we do not knowingly collect their data. Tell us if that has happened and we remove it. Links to other websites are not under our control; review their policies before you rely on them.
  12. 12ChangesWe may update this policy. We post the new version here, notify you by email and/or a prominent notice before it takes effect, and change the "Last updated" date.
02Terms and conditions

The proposal is the contract. This is the fine print.

Sixteen clauses. They apply to every proposal Aktify Studio issues unless the proposal says otherwise.

  1. 01About Aktify StudioA creative studio based in Belgium serving businesses locally and internationally: brand strategy and visual identity (logo design, style guides), web design and development, copywriting, SEO and conversion work, and automation and business process optimisation. Specialised in small to medium-sized businesses and startups. These Terms apply to every proposal you sign with us and to the monthly plan that follows it; reading this site commits you to nothing.
  2. 02EligibilityYou must be at least 18 years old or legally allowed to enter into a contract, and act on behalf of yourself or a legal business entity.
  3. 03Scope of servicesEvery project starts with a written agreement, quotation or proposal stating the services included, the timeline, and payment terms and delivery stages. Work follows that scope; anything added mid-project may require a new estimate or an additional fee. Hosting, security and backups are covered by the monthly plan; without one, the client pays any ongoing third-party subscriptions after handover.
  4. 04Payment termsA one-page site starts at €749; a full brand and web package ranges €1.999 – €4.499+. Every project starts with a pre-payment. Debut, and any project under €1.000, is paid 100% up front. Presence is paid 50% when the proposal is signed and 50% before go-live. Authority and Ecosystem are paid in three parts: the first when the proposal is signed, the second when you approve the design or at the latest 30 days after we show you the first design, and the third before go-live. Each part is a third of the price, rounded to the euro, with the last part taking the difference. Every part is an ordinary invoice under these Terms, and paying in parts carries no interest and no extra cost. Work starts once the first payment is in, and the site goes live only once the last part is paid. Bank transfer and secure online gateways (Stripe, Bancontact, credit card) are accepted; card transaction fees may be passed on and stated on the invoice.
  5. 05Non-paymentPre-payments are non-refundable once work has begun or resources are allocated; cancel in writing within 7 days with no work started and you get a full refund. Invoices are due within 30 days. Late payment carries, without notice, 10% yearly interest plus a fixed 10% compensation (minimum €75) for administration, and we may pause the project until balances are settled.
  6. 06Cancellation and refundsFull refund if no work has started and you cancel in writing within 7 days of booking; partial or none, at our discretion, once significant work has begun. A client unresponsive for more than 30 days makes the project dormant. Restarting may cost a €150 re-onboarding fee; after 3 months dormant we may terminate with no refund.
  7. 07Ownership and IPOn full payment you receive full rights to the final deliverables: logo, website code, design assets and content, and we hand over the code whenever you ask. Your domain: one you already have stays yours, at your own registrar. If you have none, we register it for you; its yearly renewal is included while you are on a monthly plan, it is yours once the project is paid, and we transfer it to you whenever you ask, at the latest when your plan stops. Accounts in your own name (Google Business Profile, analytics, mail) stay yours. Our own tools stay ours: the client portal, once it is available, gives you a login to see your figures and send requests, not access to its code or to the accounts we host on. Open-source libraries and frameworks we build on remain under their own licences. We may show completed work in our portfolio, on our website and on social media.
  8. 08Monthly plansA monthly plan is billed per month and runs month to month with no minimum term: stop it by email and it ends at the end of that month, with no notice period. The plan you choose at launch starts by itself when the months included with your project end, and we remind you by email a week before. It is paid monthly in advance, by automatic bank debit or card, through Stripe. It includes what the pricing page lists for that plan on the day it starts, with the turnaround stated there; requests not used in their period do not roll over. A small request, and a paid small change on Host, can hold several small edits to one page sent together, as long as together they take under an hour and change no design. Putting right a mistake of ours is always free and never counts as a request or a paid change. We can change a plan’s price or contents with 30 days’ notice by email, and you can stop the plan before the change applies; a discount agreed in a proposal runs for the period that proposal states. If a payment fails, a card is declined or a debit is reversed at your bank, Stripe tries again over the following weeks and we tell you by email; requests wait until it is paid. If it is still unpaid 30 days after it was due, the plan stops and the Non-payment clause applies to what is owed. When a plan stops, for any reason, including the studio ceasing to trade, we hand over the code and the domain so the site can run with any host, and we keep it online until the end of the last paid month or, when it stopped for non-payment, for 14 days after we tell you so.
  9. 09Communication and toolsProjects run in Aktify OS and Notion (documentation and tasks), Google Meet (meetings and reviews) and WhatsApp or email (feedback). Key decisions, approvals and disputes must be documented by email or, once it is available, in the client portal (coming soon). We integrate platforms such as Cloudflare, Supabase, Figma, Notion, n8n, Cal.com, Google Analytics, Meta Ads Manager and AI services (e.g. Google Gemini) and are not liable for their outages, data loss or changes.
  10. 10Confidentiality and GDPRSensitive business, marketing or technical information you share is kept private and used only to deliver your project (an obligation that survives project completion). We comply with the EU GDPR; the Privacy policy above covers collection, processing and your rights.
  11. 11Client responsibilitiesProvide timely access to content, feedback, logins and brand materials; review and approve deliverables within reasonable timeframes; communicate professionally and clearly. Delays from unresponsiveness may affect timeline and scope.
  12. 12Limitation of liabilityTo the extent permitted by law we are not liable for indirect, incidental or consequential damages; data loss, downtime, API changes, integration breakages or third-party platform issues; or outcomes not explicitly guaranteed in the scope. Total liability is limited to the amount you paid for the service.
  13. 13TerminationWe may terminate a project at any time for non-payment, abuse, harassment or breach of terms, or legal or operational barriers. Outstanding payments remain due; deliverables completed to that point are provided as-is.
  14. 14Changes to these TermsWe may update these Terms; the new version is posted here with its "Last updated" date. A change applies only to proposals signed after that date. A running monthly plan moves to the new version only after 30 days’ notice by email, and you can stop the plan before then.
  15. 15Governing lawBelgian law governs these Terms. Disputes fall under the exclusive jurisdiction of the courts of the district of Antwerp.
