Welcome to Aktify Studio. These Terms and Conditions ("Terms", "Terms of Service") outline the rules and regulations for using our website (https://aktifystudio.com) and working with us as a service provider. By accessing our site or engaging our services, you accept these Terms in full. If you disagree with any part of the Terms, please do not use our services.

1. About Aktify Studio

Aktify Studio is a creative agency based in Belgium providing digital services to businesses locally and internationally. Our core offerings include:
– Branding (logo design, style guides)
– Web design and development
– Digital marketing (ads, social presence)
– Automation and business process optimization

We specialize in working with small to medium-sized businesses and startups.

2. Eligibility

To use our services, you must:
– Be at least 18 years old or legally allowed to enter into a contract
– Be acting on behalf of yourself or a legal business entity

3. Scope of Services

We provide creative and strategic services based on a mutually agreed scope. Each project begins with a written agreement, quotation, or proposal outlining:
– Services included
– Project timeline
– Payment terms and delivery stages

All work is performed based on that agreed scope. Any additional services requested mid-project may require a new estimate or additional fee.

4. Payment Terms

– Prices vary by service. For example, a branding-only project may begin at €500, while a full-service brand and web package ranges between €2,000–€2,500+.
– All services require a pre-payment (deposit) to confirm and initiate work.
– We accept payment via bank transfer, PayPal, or cryptocurrency.
– Final payment is due before project hand-off or go-live.

Non-Payment & Pre-Payment Policy
– Pre-payments are non-refundable once work has begun or resources have been allocated.
– If the client cancels within 7 days of payment and no work has begun, a full refund may be issued.
– In the event of late or missed payments, Aktify Studio reserves the right to pause the project until outstanding balances are resolved.

5. Cancellation & Refunds

You may cancel your project under the following conditions:
Full refund: If no work has started and cancellation is requested in writing within 7 days of booking.
Partial refund or none: If significant work has begun, refunds are at our discretion based on the progress completed.

If the client becomes unresponsive during a project, Aktify Studio will make reasonable efforts to reach out. If we cannot proceed due to missing input, we may mark the project as dormant, and full or partial payment may still apply depending on project progress.

6. Ownership & Intellectual Property

– Upon full payment, you receive full rights to final deliverables (e.g., logo, website files, design assets).
– Aktify Studio may utilize base templates or frameworks (e.g., Relume components), which remain non-exclusive tools.
– We reserve the right to showcase completed work in our portfolio, website, or social media for promotional purposes.

7. Communication

Official communication and project management will occur through:
Notion (for project documentation and task management)
Google Meet (for meetings and reviews)
WhatsApp or Email (for general communication and feedback)

For legal purposes, key decisions, approvals, or disputes must be documented via email or Notion.

8. Use of Third-Party Tools

We may use or integrate with external platforms such as Webflow, Figma, Notion, Airtable, Google Analytics, Meta Ads Manager.
Aktify Studio is not liable for outages, data loss, or changes made by these third-party providers.

9. Confidentiality

We respect your privacy and confidentiality. Any sensitive business, marketing, or technical information shared with us will be kept private and used solely for the purpose of fulfilling your project. This obligation remains in effect even after project completion.

10. GDPR & Data Protection

We comply with the EU General Data Protection Regulation (GDPR). See our Privacy Policy for full details on data collection, processing, and your rights.

11. Client Responsibilities

To ensure smooth collaboration, the client agrees to:
– Provide timely access to content, feedback, logins, and brand materials
– Review and approve deliverables within reasonable timeframes
– Communicate professionally and clearly throughout the project

Delays caused by unresponsiveness may impact project timelines and scope.

12. Limitation of Liability

To the extent permitted by law, Aktify Studio shall not be held liable for:
– Any indirect, incidental, or consequential damages
– Any data loss, downtime, or third-party platform issues
– Any outcomes not explicitly guaranteed in the project scope

Our total liability under these Terms is limited to the total amount paid by the client for the service.

13. Termination

Aktify Studio reserves the right to terminate a project at any time due to:
– Non-payment
– Abuse, harassment, or breach of terms
– Legal or operational barriers

Upon termination, all outstanding payments remain due. Any deliverables completed up to that point will be provided in “as-is” state.

14. Modifications to Terms

Aktify Studio reserves the right to update these Terms at any time. Changes will be posted on our website, with the “Last updated” date adjusted accordingly. Continued use of our services implies acceptance of updated Terms.

15. Governing Law

These Terms are governed by the laws of Belgium. Any disputes shall be subject to the exclusive jurisdiction of the courts in Belgium.
